Follow-up FOIA Request re Pensacola's "No Records" Response (Item 2.139)
TO: Lt. G. W. Eden, USN
Freedom-of-Information Coordinator, JAGC

Box 102, Naval Air Station
Jacksonville, FL 32212-0102
FROM: Larry W. Bryant
3518 Martha Custis Drive
Alexandria, VA 22302
DATE: November 13, 2011
1. Reference: Your letter to me of November 8, 2011 (as printed below), in which you reply to my Nov. 6 FOIA request (your file No. 12-05; my blog Item 2.135) by declaring that neither your command nor the Naval Air Station Pensacola (NASP) can disclose records responsive to my request. Please note that the subject line of my Nov. 6 request contains a typographical error: giving the date of the NASP anti-UFO attack as "Oct. 28," 2011, instead of the correct date of Oct. 23, 2011. If your ensuing records search concentrated only on the "Oct. 28" date, I ask that you resume the records-search under the criterion of the Oct. 23 date (as expressed in the body of my original request).
2. I'm incapable of concluding that no military command/unit has generated/acquired any records about any Navy-related event of the magnitude represented by the NASP-led attack of Oct. 23. Accordingly, in order for me to gain information and perspective useful in crafting a formal appeal of your "no records" determination, I submit this letter as a written follow-up FOIA request that you send me a photocopy of (1) the entire contents of your command's FOIA case file No. 12-05 and (2) the entire contents of all other Oct. 23-related FOIA case files created, to date, via others' requests -- said records to include each case file's processing log, action officers' tasking documents/notes, records-review referrals/results, records-search criteria applied, computerized reports of files examined for responsive records, and all executive correspondence (including e-mail) generated by proponent offices.
3. By USPS mail, I'm sending to you a signed printout of this e-formatted letter.

Ser NOOJ/899
08 NOV 2011
Dear Mr. Bryant
This letter responds to your Freedom of Information Act request dated November 6, 2011, in which you sought a copy of records maintained by Naval Air Station Pensacola, Florida, regarding an Anti-UFO attack on October 28, 2011, and records pertaining to all attacks from November 6, 2010, through November 6, 2011. Your request was received in this office on November 7, 2011 and was assigned file number 12-05.
A thorough search of our records failed to disclose records responsive to your request.
If you feel that the search of the records was not complete, you may appeal this determination in writing to: Judge Advocate General of the Navy (Code 14), 1322 Patterson Avenue SE, Suite 3000, Washington Navy Yard, DC 20374-5066.
Your appeal must be postmarked within 60 calendar days from the date of this letter. A statement as to why your appeal should be granted should be included and a copy of this letter should be attached. Both the appeal letter and the envelope should bear the notation "Freedom of Information Act Appeal.
There are no fees associated with this request. Any questions concerning this matter should be directed to Ms. Joanne Parra at (904) 542-1528.
Sincerely,
G. W. EDEN
Lieutenant, Judge Advocate General's Corps, U. S. Navy
